Property transfer

(Querist) 28 March 2012 This query is : Resolved
Dear Sir,

Is it true that the stamp duty during registration process in
sale deed and gift deed is same
for a land (Plot-residential) from father to son . I have been told so that there is no concession in stamp duty even in case of inside family transfer. I am in Lucknow and property is also here . Please give suggestion that how it can be transferred from father to son(myself) in minimum expenses.

Thanks. A K Dwivedi

In my opinion for the gift stamp duty is minimum. Refer the state stamp act.

No. The stamp duty for gift deed is the same as that of conveyance deed.
You can execute a will in favour of your son. There is no stamp duty on will. Only registration charges.

In lucknow, stamp duty for sale deed or gift deed is 7%.

As you asked that can be transferred from father to son(myself) in minimum expenses.

Answer: execute and register "WILL" in your favour.
