Non refund of fee

One year back I paid Rs.5000/-to a coaching institute for my sons admission
for coaching of banking exam.On the same day my son attended the 1st lecture.The small classromm was crammed with 50 students who were made to sit on a stool without a writing table.Before taking admission I was assured that there would be no more than 15-20 students per batch.I confronted the manager who accepted the money, about this and he told me that he cannot do anything about it.Within 5 hours of paying the fee,I asked in writing for the refund of the fee amounton the same day..The manager said that he will forward the same to their head office for refund decision and told me that once the fee is paid,it cannot be refunded.The head office did not care to reply to my application for refund.I again sent,after some months, a letter to the head office to remind them about my refund.I gave them 15 days time to reply.I sent the letter through registered post.Still no reply.Can I approach the cosumer court for deficiency in service? I stay at Vile-Parle east.How and where to go for the consumer court.Will it be costly? I do not want to pay 5000 to get back 5000.It will not be a justice.My son had attended only 1 lecture.

Please advise.

yes you cna paproach consumer forum for deficency in service , ask for refund and compensation .better fight case on your own . lawyer fees will be more than rs 5000

File a consumer complaint before consumer forum and get the desired relief.

First issue legal notice to the institute claiming compensation for their negligence and to refund the fees paid. If you received fees then no problem, otherwise file a complaint in the consumer court.

File a complaint before the Consumer Forum alleging deficiency in services & claim for refund of the fees paid by you alongwith interest, damages & cost. You can fight it yourself & it is not difficult. Try it.

You can approach the court for deficiency in service and unfair trade practice. If you want to save the advocate fees, you will have to contest the case on your own. The filing fees for consumer complaint for amounts less than 1 lac is rs.100/-. Along with the refund, you can claim compensation for harassment and mental agony, expenses incurred in filing the case etc.
