after court pronounced judgement in court and file consigned to record room decree can be set aside on the request of defendent who was defaulter in filing w/s,defence struck,didnot deposit cost imposed by court for defaults and did not appear on any date except ist appearance. he once got setaside exparte proceedings and thereafter he again failed to appear

court can set aside exparte proceedings in interest of justice . court may direct defendant to deposit decretal amount in court and set aside exparte decree .

Defendant has got every right under law to file an application to set aside the exparte decree. Setting aside or otherwise depends on the facts and circumstances of each case. Just because he has got set aside exparte order once and yet failed to file WS will not render his claim nugatory.
