(Querist) 01 July 2012 This query is : Resolved 
If husband has obtained decree of restitution of conjugal rights against his wife who being directed to joint him within two months. Failure of wife to obey the decree. What is the recourse of law to enforce the decree for its satisfaction.

1. He can execute the decree by way of attachment of property of the wife,
or
2. File a suit for divorce after one year of passing of decree.

yes.. after one year from the date of order you can file the petition for divorce..

court will grand it without problem..

Wife is not owning any property and i don't want to give divorce. Then how to execute the decree.

No. If she does not want to join you, she can not be forced to obey the Court order. She can be punished for not complying with it. Only course of action is amicable settlement.
