Mr.X was allotted an open land to freedom fighters under land type C and the society was registered under Co-Operative Societies Act in Maharashtra. In Society's Memorandum of Association there is a clause of transfer of such property to the person who is a freedom fighter/s only. Mr.X wants to sell the plot to other than freedom fighter. Is there any amendment in such clause to transfer under such specified clause to person other than freedom fighter. The land was originally allotted by govt.of Maharashtra. The society formed acquired the land for the use to freedom fighters only. Is there any solution to transfer such land to other than freedom fighter. thanking you.

no . if it is specifcally mentioned that property can be transferred to freedom fighter only then you cant sell it to any buyer . society wont permit sale of property to third parties who are not freedom fighters
