This query is : Resolved
A commercial co op. society did not allow a bonafide owner of the premises to use the premises saying that the room was illegal and filed a case against him in city civil court which was dismissed as withdrawn. Is the owner liable to pay society dues ? Pl. help and guide suitably as the society is on record saying it did not allow the owner to use the premises and even after court verdict is not allowing the owner to use / rent out the premises.

In this case, owner is required to go to court and obtain specific order to use his own room as the withdrawal of the case by society shall not help him. It is good for him to regularly pay the maintenance expenses to the society so that he may show his bonafide thereon.

Respected Makkadji, We do know that society dues need to be paid but you have missed our actual query. What if society does not allow you to use the office premises in spite of the fact that you are a member due to goons in control of society and then goes to court saying room was illegal and the court dismisses the case as withdrawn ? Even now these criminals are not allowing the use of office premises so do you suggest that we have to pay the society dues / bills for the period we are not allowed to use the premises ? We are willing to pay property tax as it is ownership premises. Experts pl. don't shy away to answer the query.
