Maintenance by husband to his girl child

I've filed a Domestic violence case against my husband who tortured me physically and mentally and asked for maintenance for our child girl child who is 4. Can u tell me how much percentage of his salary can be given as maintenance for the child or how is it calculated. he is apporx earning 60,000 per month. As I'm working, am I not eligible for maintenance?

you have not mentioned how much you are earning . basically if you are well qualified and earning a decent salary you wont get maintenance . however your daughter is entiled to maintenance .
your advocate will make out a case for maintenance .no fixed percentage is laid out . court considers whether husband has dependent parents , housing loan EMI , educational expenses of the child etc while passing an order .

yes you are not entitled to get maintainance as you have ur own income. But u can claim for your daughter. There is no formula to calculate the amount of maintainence it depends on howmuch you need and how much your husband can earn. In your case you can claim min 10000 PM.
