A patient complaining of regular stomach pain, indigestion, omitting sensation etc after undergoing pathological tests at lab told by Doctors of a reputed hospital was then told tobe suffering from Hepatitis B. As line of treatment, he was asked to complete course of 24 weeks by taking a particular Injection every week. Cost of the Injection was Rs 22,000/- per Injection.
After completion of the course of treatment, the patient did not feel better, the Doctors of the same hospital then told him to undergo surgery for Hernia. He underwent that too.
Still there was no relief for the patient.
All along he has been under treatment at the same hospital and under the same team of doctors. Now he has been told that he needs Liver Transplant.
I would like to know, if there is any scope of taking the case to consumer court? What are the factors that are required to be checked before determining if it is a proper case for taking to consumer court? Is there any expert Lawyer who can help giving free and fair opinion in the case, on payment of his requisite fee?

you must be having reportof your diagonsis . based on your medical report doctors must have suggested lie of treatement . reuqest hospital to furnish your medical report , recommendations made by doctors as you want it for your record .
take a second opinion of another doctor . then decide your course of action

In the given case, you shall have first to get expert reports that the treatment given to you in the past years is incorrect and that you had not that disease which was diagnosed and treated. You can file a consumer complaint only thereafter. The experts should possess more qualification than the treating doctors or at least equivalent to them so that those may be prodduced at the time of evidence if need arises so.
