Child custody and travelling out of country

Guest (Querist) 04 January 2013 This query is : Resolved
hi,

i am separated from my husband for 4 years.we have a daughter who has been in my custody since birth and my husband has not taken any efforts in meeting my child.

we are not divorced yet and there are no cases against each other that is pending in court.

i wanted to know if i can travel out the country with my child. should i get my husband's permission / child custody before travelling ?

i am not interested in filing any cases now , nor interested in seeking his permission as we are not in talking terms for the past 4 years.

As there is no any legal issue pending between you and your daughter is peacefully living with you under your custody so why to ring alarms and invite your husband to come to courts against you and raise obstructions in your future plan. You have no need to ask from him.

are there any legal requirements that both parents should approve for the minor child to get visa etc ?

@raj kumar makkad ,

sir , thanks for confirming. but wanted to know if i might be in trouble in the future for not informing my spouse

You shall not be in any trouble as you are natural guardian of your child and visa offices of maximum countries generally do not require such information
