Sir,
We are a family of 6 members. My father expired on 15 days back. We have a immoveable property on which apartments being constructing under a joint development agreement done last year. Now, the developer is want us to execute a release deed from my mother in favour of her children (4 of us) to get new GPA from the children to continue the construction work. I'd like to know whether they is any such requirement. If so, is there any stamp duty involved in it and post registration do we need to get legal heir certificate from the court for the same. Please advise and my thanks to all in advance.

who owned immoveable property? was it only in your father name? who are the parties to development agreement? contact a local lawyer . you can afford legal fees

The property is there in the name of my father. Parties are my father and children (4 of us) and the developers by name x.

In the given case, you all are equal owner to that property with your mother and your mother only can release her share in favour of her children but if the builder gets the regsitered sale-deed directly in favour of you all 4 brothers/sisters, there is no requirement of release deed.
