The following questions arise for clarification by you:
1) Whether job description is there to be followed by the employee?
2) Whether rational work standards have been prescribed by the standard work measurement methods?
3) Whether work performance requirements have been prescribed in the Employees Conduct Rules or the Certified Standing Orders?
4) What are the terms & conditions of his appointment?
In fact, the incident cannot be treated as a misconduct, as work standards should be on averaging methods of the capacity and capabilities of the different performers in different environments.
An employee's poor work performance can affect his promotional avenues, but cannot lead towards his dismissal.
In my views, as an HR Manager, you need to check with the employee, if his performance is being affected adversely by the environmental effects, his domestic problems or the cruel attitude of his superiors & colleagues towards him.
