If a bank does not publish a newspaper publication within 7 days (or not at all), dos the notice under section 13(2) remains valid ? Can the bank restart from 13(4) again ?

Unfortunate indeed. Lawyers cannot reply on the principle of law. What a shame. My case is a historic one and even a summary will be some 90 pages long which your blog cannot accomodate.

Summary of SARFAESI Proceedings initiated by the Bank will take hardly 3 lines.

However, the Bank has to publish Possession Notice issued u/s13(4) of the Act within 7 days (currently amended to 2 weeks). Demand Notice u/s 13(2) need not be published.
