It can be criminal or even civil depending solely upon the nature of the case. Nothing can be presumed without any brief description of the case by you.

Well said by Dhnigra Sir. Under Sec. 211 of IPC, we can file criminal case to get him punished. Under civil law we can claim damages.

Under Criminal law under Sec. 211 of IPC. Relating to civil suit, I have no idea under which Act damages can be claimed under civil law.
