Good Day Everyone
I have just returned from Delhi where I had rented a 1BHK for 11months at the rate of Rs 12,000 per month and water charges of Rs 500 per month with a one month notice period of termination of the rental agreement from either side
On June 3rd 2013 I had a conversation with my landlord about my intention to leave Delhi as I had formally put in my resignation at work.
Within a week we had verbally agreed to a final date of August 3rd considering my notice period and the fact that my landlord would be out of Delhi till July 29th (was visiting his daughter in Canada) and I was to keep an eye on the property till the time he returned.
Things proceeded well till the time the following happened
1. My father was scheduled for prostate cancer surgery
2. My organization agreed to relieve me earlier than the last working date
Post his departure to Canada (around 4th or 5th July), I informed my landlord I would be leaving Delhi on July 6th; however I was not able to assure him if I would be coming back to Delhi to settle the security deposit. I had handed over the keys to the other tenant as per my discussion with my landlord.
On August 1st I called to speak about the refund and detailed the calculation as
1. Rent and water payable from July 1 to July 5th (5 days)
2. Maid (Rs 600) & sweeper (Rs 150) payable for June plus 5 days of July
3. Electricity bill at actual
I was rudely informed that I had not
1.Informed him of my intention to leave
2.Handed over the property as per the terms of the agreement
And as such I would be charged till August 5th.
My questions are as under
1.Can my landlord charge me for rent and water charges till August 5th
3.How can I get my deposit post correct deductions
He has already made a deduction of Rs 16,715 from the security deposit amount without any detailed information of the same and deposited the balance of Rs 8,285 into my bank a/c.

In absence of written notice to landlord to the effect, he was justified in charging the rent for one month. You may send him a letter to give you the details of Rs. 16,715/-.

SORRY!Your's is a wrong agitation.
The letting was @ monthly rent not daily.
The agreement was terminable on one month
notice.
So either you gave notice or not,you are legally bound to pay at least for a month,
whether you occupied it for(1) one day or twenty nine(29) days.
