Professional deficiency

(Querist) 13 August 2013 This query is : Resolved 
I had entrusted to an advocate a consumer court case against a Govt organisation. He took the professional fees from me but never presented himself in the Consumer Forum. The case was dismissed due to non representation by the complainant. I complained to Bar Council on the advocate. I got no response. What should I do. I want him to pay back the fees that he took.

You may send reminder to the Bar council. Agree, till you have receipt of payment to lawyer, success of fees paid recovery is doubtful.

how did you pay the fees? by cash or cheque? follow your case with bar council

If your lawyer had filed the Vakalatnama in the consumer forum on your behalf and even then he didn't attend the court then the professional misconduct is duly established in the given facts irrespective of the fact whether the receipt of the fee was taken or not.

Again make reminder to Bar Council failing which approach to BCI and then to high court.
