Want to avoid divorce

(Querist) 21 September 2013 This query is : Resolved 
My wife staying separate for 11 months & wants a divorce. I tried to convince her by all means. By next month she may send me a legal notice. I don't want this divorce to take place.
As this is not mutual case of divorce, how should I respond to her notice.
Is it so? that if divorce case is not mutual, court doesn't send us for counselling?

Please guide me stopping the divorce to happen.

it is in your interest to agree for divorce by mutual consent . . on filing of petition case is referred for counselling .

if both parties dont agree then case is placed for trial . contested cases take years to be disposed of

If the counseling is not succeed, better go for mutual consent divorce.

Dear Ajay Sir & Rajendra Sir,

I am unable to understand your suggestions. Do you both mean that I should agree for divorce or file for it myself, even though I am against it?

I dont want this divorce to happen. If I receives a notice from wife, how should I respond to it in order to avoid the divorce.

dear prasad,

most of the experts answers are based on legality of the case.

since you are not interested in the diverse and no legal notice has been served on you till date,try to have some conciliation efforts,with the help of common friends and relatives,without any prejudices and unwanted egos.

from your post it is not clear,whether you took any initiative for a counseling,without waiting for a court direction in this regard.

there are limitations on giving proper advise on such matters on a virtual forums.

if you are sincere in solving the issue,think of the attributing causes if any from you and your family members for her desertion,within such short span of marriage.
