Kindly help me. What action I can taken and how can I release my bike from RTO without penalty.
Can I take any action against police to threat for fraud case and beaten in police station and another for challan.

First of all, you shall have to develop courage for desired action against the police and once it is developed, mind it that concerned police officials shall have to face dismissal from service as the incident is grave violation of constitutional rights of an innocent citizen and is an illegal confinement.
Make complaint to even senior police officials along-with human rights commission. Go to hospital and get MLR.

Only Writ would yield proper result. File writ petition in the high court.

I agree with Mr. Devjyoti. Complaint to NHRC in most of the times is not bringing the positive result. What they do is to refer your complaint to the higher police officer of your state and seek report, which will be tailored to protect the offending police personnel. Hence, writ brings positive result subject to your production of proper documents relating to your illegal custody and beating there.
