Dear Sir, i have filed summary suit case in mumbai as one person is cheated me for Rs.10 lacs and doesnt not give us our money back.
from the court one person gone for deliverying the summons to that person;s house but they refuse to take the delvery and states that he doesnot live here and doesnt not come here from last 6 months.
Kindly guide me what is the legl procedure to take my money back. Thanks & Regards

if you are unable to effect service at his last known address make an application for substituted service .

Yes, apply for paper publication.

You have to apply for a paper publication in the court. The court will allow to publish the notice in a particular daily which is having the circulation, to the area, where in the Defendant lived (last known address).
