T. Kalaiselvan, Advocate (Expert) 15 March 2014
Right to permanent alimony is a statutory right. The right to get maintenance remains unaffected by the ground of fault found on the part of applicant, on the basis of which decree of divorce, judicial separation, restitution of conjugal rights or annulment of marriage was passed. Permanent alimony and maintenance can be granted in the cases in which divorce is passed under section 11 of HMA too. Therefore the time spent together after marriage is not a criteria.
