My friend is not that educated person,has attended only 8th standard,but can read,write and sign,he does not have school leaving certificate showing his place and date of birth,nor he has birth certificate,passport officer is insisting for his Birth Certificate/School Leaving certificate and is not accepting his affidavit under Annexure "A",saying that it is for illiterate persons,what is the solution/remedy left for him w.r.t.his age and place proofs to get a passport!

He should contact relative school for school leaving certificate. Birth certificate can be obtained from local Municipality. If the birth was not recorded, process for its late recording should be adopted.

If the birth was not registered with the competent authority for the purpose, now he can get the same only by an order of the court directing the authority to issue it.

I have understood,the only way is through the court,but I want to know,suppose if he had enrolled himself in an unrecognized school in Madurai in 1975,his birth certificate would have been there with the school?,he has studied upto 8th stand in various schools in Madurai

If the birth certificate can be with the school, the record must be existing with the Municipal corporation, duplicate birth certificate can be taken from there on payment of nominal fees.
Otherwise approach the court for orders to enter the DOB and issue birth certificate.

1. A simpler solution would be to contact the local "Gram Panchayat" office, and request them to issue a) Birth Certificate and b) Resident Certificate. (This may require some adjustments with the local person)
2. The above two documents are more than enough for the purposes. These two documents are also enough making for PAN card and Aadhar Card.

Mr.Balasubramanian,
You say that he studied in various schools till 8th Standard. Do you mean to say that all those schools are unrecognized schools.
Let him try to get the certificate from the school. In case of problem let him come back to us.
