Query regarding rent amount on pagdi system home

Hello all,

We have taken pagdi room 32 years ago.

now from 5 years we are living in own flat, and the pagdi room is locked (nobody is living over there)

until now, he charged us rent rupees around 200 per month. which we are giving him till Dec 2013.

we usually pay him on quarterly basis so to pay next bill we went over there on APR 2014 but he refuse to take rent and said that decision of rent rate increase will coming soon and he will charge according to new rates.

yesterday when he called us , we went to pay rent but, he saying that from now onward you need to pay rent 1000 Rs/ month.

He did not repair his building in last 30 years.

Can building owner increase his rates suddenly by 5 times? from 200 to 1000.

I advise to pay Rs. 1000/- Rent.
[You have remedy to go for Standard Rent, to be fixed by Court]

Reason: As you do not use the rented room, and having suitable alternate accomodation, you are bound to vacate it, loosing your right as tenant.
So avoid that risk, pay now, get receipt, then go to court for std rent, if you so wish.
It is investment/ not rent.. / not wasted.
u will have more bargaining power..

i agree with Mr shroff . pay rent as demanded by landlord. if he files suit for eviction on grounds that you have alternative accommodation you would be in trouble . dont go to court .

Hello V R Shroff and team,

Thanks for reply. however can you please tell us what are the rights of pagdi owner.I have some doubts as below

1)Will we get the flat of same carpet area if this building goes under redevelopment with same square feet rate which had at that time (i.e 35 years before)

2) If we want to leave the rights of pagdi, and goes for negotiation, how much shuould he offer to us.

(we had paid 25000 Rs as a pagdi in 1980, and we have 340 sq feet carpet area.
current rate per square feet is around 8000 Rs now. so if we leave the rights and goes for negotiation how much should he offer?
