RESPECTED SIR,
I AM FROM A SMALL TOWN OF M.P., FROM MY HOME I HAVE ONE MORE HOUSE (SINGLE STOREY) 15 KM FAR FROM MY HOME AND THAT IS GIVEN TO A AGENCY ON RENT AND THERE IS NO AGREEMENT IN DOCUMENT ONLY VERBAL AGREEMENT. WORKERS OF AGENCY ARE RESIDING THERE FROM PREVIOUS 1 YEAR. THERE IS NO RAILING/PARAFIT ON ROOF AND WORKERS SLEEP ON ROOF IN NIGHT (SUMMER), BUT 15 DAYS BACK ONE WORKER WAS PISSING FROM ROOF AND FALLEN AND GOT DEAD.NOW POLICE IS SAYING THEY ARE CHARGING ME IPC304 FOR NOT HAVING RAILING/PARAFIT ON ROOF.IS NOT HAVING RAILING ON ROOF IS AN OFFENCE. IS IPC304 IS APPLICABLE HERE . PLEASE SUGGEST ME WHAT SHOULD I DO NOW.

Of course you are liable to make the house safe otherwise face the consequence.

If the charges has been leveled, engage a lawyer expert in criminal cases and defend yourself.

sir my doubt is in this case IPC 304 or IPC304A is leveled, police is saying they will charge IPC304, they have not charged till date but saying...so I am affraid of IPC304.

Please come with facts of the case. Nobody goes strainght to thana. There might have been some argument regarding compensation.

Any criminal charge for the incident is far fetched. In fact, you are not liable for any civil or criminal action. The onus fell the tenant agency to ensure that its workers did not use the premises in an unsafe manner.

thank you so much for your valueable suggestions. sir the person who died is from other state nobody is from his family is here and so nobody is talking about compensation,even agency is also not interested in this, only police is involved.

The police can twist the case in any way depending on the their palms are greased on such accidental matters. You try for some way which may help you come out of the crisis, but this is not a legal solution.
