A rent receipt is in the name of a tenant since the year 2000 and obviously a tenant is also paying a rent to a landlord since then in Pune. In the year 2005, a tenant went to Solapur for employment purpose and then transferred his ration card from Pune to Solapur. Meanwhile a tenant never sold his tenancy rights to anyone and instead kept his room locked till the year 2007. In the year 2007, the landlord filed a case for possession of the room on the ground that a tenant is not staying in Pune room evidenced by a ration card. Is possession possible for a landlord under Maharashtra rent control act? Can tenant win this case?
