Nri seeks inheritance property advise

Hi Sir/Madam,

I required advise on the below.

1. My father has property/money in the bank in India - Hyderabad.

2. 3 Brothers, 4 Sisters and 1 Mother are the legal heirs.

3. 2 Sisters received their share and mother doesn't want share.

4. One brother wants more share out of the total share as he is BIG.

5. Big Brother said if other agree to give more share to him then only he will allow to do other registries.

6. Now i required my share as I feel he may misuse the property and do some hidden registrations.

7. I am residing in Dubai - UAE and I don't know what to do?

Kindly advice me what to do with property and money in the bank.

You can appoint a lawyer to File a suit for partition of the property.

it is necessary for you to appoint lawyer in hyderabad . as far as money in bank is concerned did your father have single account or joint account . did he leave any nomination with the bank . money lying in bank account is for benefit of all legal heirs . your brother cannot do any registration of property without consent of other legal heirs

Engage a local lawyer and file case of partition. You can give power of attorney of the case to some of your relative and continuously follow the proceedings.

Money in the bank doesn't have any nominee...

Shall i file 2 cases i.e., 1 for money and another for property?

In the same suit for partition you can lay your claim on both movable and immovable properties. No need for separate suit.

Court fees depend on the total value and the lawyers fees on the lawyer. Please approach a lawyer in tour locality directly.
