Construction of boundary wall

Dear Members,
I Stay In Kolkata. I want to construct the boundary wall of the house in which i saty., but neighbours are anti-social as well as the local municipal is not helping us. We filled case but it was rejected on the basis that i don't have sanction plan.i cant make sanction plan as the boundary wall is not there. The other side neighbours are constructing their house G+2 without leaving "4" Inch Space as required. but no one is objecting them.Please help me getting the solution.

You have ti file a suit for partition and injunction.

Getting sanctioned plan on your premises is your right and if the KMC is not allowing this you can move to high Court.

if neighbours are not leaving 4 inch mandatory open space as required you can move court against your neighbours . file complaint with KMC

When my house was build..at that time it was gram panchayat at that time there was no such rule. .now its a municipal corporation. . I have even consulted lawyers. They told me even your house is built without leaving the space. .so sanction plan cannot be made.. the neighbours are strangers rape. Murders cases are lodge with them..and another is a school headmaster. .so I m afraid also.

In the second floor the additional floor can be constructed by keeping set back area.

Consult a good lawyer.
