FSL vs private expert

(Querist) 02 January 2015 This query is : Resolved
My question pertains to two conflicting reports regarding an alleged forged Will. I am the complainant in the case. The trial Court Judge ordered the Forensic Science Laboratory to send a report on wether the said Will was a forgery. I gave original documents including passports etc of my Late father which were duly excepted as genuine by FSL. The report was received in the trial Court and Will was deemed not bear my Father's signature by FSL. Afterwards the accused party hired a private handwriting expert who using different signatures (which are fake) from the electricity board made another report claiming the Will to be genuine. My question is which report should the trial Court except if any? Thank you for your time.

Of Course the report of expert appointed by court will be accepted by court. The report of private expert has no value here.

Court will accept the report given by the FSL .

FSL is independent body and taken to be correct and unbiased against a private paid expert.

Moreover the private expert has not compared the signatures FSL used as model hence he has failed to assail FSL'S REPORT.

The FSL's opinion will be taken into consideration by the court.
Biswanath Roy (Expert) 05 January 2015
The trial court will accept FSL report only for two reasons, namely,-(a) The court itself ordered for forensic test of the will, and (b)Forensic test is much more reliable and dependable for determination of forgery in as much as such test is based on scientific examinations in various ways and manners by examining ink and period of signature. WHEREAS, hand writing expert's report is based on mode and style of writing of the testator which can be copied by an expert copyist.
