Weekly off

Respected Sir,

I have a query on Weekly Off. Request to let us know for an entitlement of a Weekly Off, how many days an employee to work.

The query is explained in below scenario's.

Scenario 1.

An employee is working 5 day week. Monday to Friday, Saturday & Sunday will be his WO. He is on LOP from Wednesday - Friday and resumes to work on next Monday. Will he get Weekly Off. If yes, will it be for two days OR only for one day.

Scenario 2.

The same employee is on LOP from Monday to Friday, and resumes to work on next Monday. Will he get his WO. If yes, for how many days.

In both cases the employee is joining on Monday.
Sat,Sun being weekly off shall remain weekly off.......

Your query is half baked in the absence essential facts. You have not stated whether the office/ work place of the employee is closed or that works on Saturday and Sunday also for other employees not due for weekly offs. Further, whether your organisation's leave rules for employees provide for suffixing holidays/ weekly off days with leave or not.

Dear Sirs,

Thank you for your valuable suggestions. Please find my concerns.

1. When an employee who has not worked OR on loss of pay for 3 preceding days, how will he eligible for weekly off? As per my understanding, an employee will be eligible for weekly off, provided if he is worked for atleast 3 days OR if he is on paid leave. In 2nd scenario the employee has not worked completely for whole week, not understanding how he will be eligible for 2 weekly off inspite of not working for 5 preceding days in that week.

2 Sorry sir, the office works even on Saturday and Sunday also. Weekly off's are on rotation. Just for sake of understanding took the example of Mon - Fri.

3. No, as of now, our organisation's leave rules does not talk anything on suffixing holidays/weekly off days. However, what we are practicing is if an employee is on Loss of Pay continuously for 2 days we are giving one weekly off and the other as LOP. In case if an employee do not work or on LOP for entire week (for 5 days), we are not giving any WO.

Kindly let us know what is law, also advice us whether legally our practice is fine or not.

In absence of departmental clarification regarding prefix or suffix of holidays with leave, the employee is entitled for holidays.

Dear Shashidhara,

In view of your clarification, your views, as in para #1 are correct. Weeky off becomes due only after rendering duty for the minimum prescribed days. So, in the first scenario only one day's WO and in the second scenario no WO becomes due to the employee.
