sir we have given power to a finance guy for our house document worth 80 lakhs, to get 3 lakhs from him . we have registered the power, after an year we found that he is tryin to cheat , when we put EC and saw he has put an sale deed using the power.after that we have cancelled the power of attorney.
now he has filed a case in the court, how to protect our property.The finance guy has put an sale agreement for 25 Lacs and has stated that he has received Rs 50,000 as advance and the sale has to be done within a year.what are the chances for us to defend and win the case? For 3 Lacs we cant afford to lose our hard earned savings ! is there way to secure it? The finance guy has our original document.Please help

Sir,
He has fraudulently used that power of attorney, defend your case on merits and at the same time file an FIR for cheating and Criminal misappropriation of documents in transferring the property ....
File a suit for injunction against the new buyer and protect your interest ...

if as per POA the agent was granted power to sell property also then in exercise of power of attorney he could have regd sale deed . it i s necessary to peruse POA cited by you to advice

Since before forming a considered opinion on the query raised,it will be proper to to go through a copy of the regd. POA and other connected details,it is better to consult an experienced civil lawyer locally for taking appropriate steps in the matter.
