My Dad had bought 7 kathas of land in Jharkhand on my mother's name in 2005. Small pillars in the distance of two feet was given as a boundary. As we are settled in Mumbai for earning, cannot visit our native place on regular bases. This year when we visit our native place, we came to know the person who had sold the land to my dad has also sold 3 kathas of our land to two other person, 1.5 kathas each by changing and creating false plot no. and one of the recent buyer has also started the construction of house on our land. The selling of land was done with informing us. We thought for the out of court settlement but the owner is incoporative. I seek your guidance in this matter.

Sir,
Was the land registered in your name when the same was bought by you ?
Because of the same was registered in your name, the subsequent buyers legally cannot buy that piece of land.
It's advisable to register a complaint of cheating and forgery against the seller and conspiracy against the subsequent buyers for buying the property with the knowledge that the property is already registered in your mother's name.

File suit for declaration and permanent injunction. Also prey for stay on construction by the third party on the land in your name.

if the land is encroached then let your mother file criminal case.

Thank you all for the suggestions. But as the property is in Jharkhand which is full of corrupt people and goondas. I cannot even trust the local advocate over there. So it would be of great help if you can guide me whether to file a criminal case or civil case because I want a relief as soon as possible.
