Legal heir versus nominee who is another legal heir

(Querist) 08 September 2015 This query is : Resolved
Dear Sirs,

Request advice on my below query:

What is the procedure available for a Legal heir to claim his share of his deceased fathers’ bank deposits, without litigation (that involves considerable costs), if the Nominee of the deceased depositors’ bank deposits,
who is an other legal heir, refuses to part with other legal heirs’ share of deceased depositors’ bank money?

In a situation, where Nominee says that only if other legal heirs sign release deed giving up their rights on ancestral immovable property, will he (Nominee) part with the share of other legal heirs in deceased depositors’
bank money.

If not interested in legal process, take help of elders in your relations, if the nominee has refused to part with the shares of the legal heirs.

No other alternate but to adopt legal process in absence of any amicable settlement.

This is transgression/blackmail.

If this legal heir does not adhere to legally valid and sensible advises of elders/neutral persons/influential ones say in the community.........................then what other remedy you have ..................than to approach state/court of law!
