Dissolve managing committee

Dear Sir,
I am residing at CHS, Mumbai.
MC not functioning properly & not solving members problems. Total 20 members, 14 are against MC & want to dissolve MC & form new MC in one meeting only.
MC never accept correspondence & takes only one AGM thru year for members.
Last Election in 2007 & then in 2012 only Chairman co-opted & not ready to kate election before 2017.

Can members call SGM uorself & dissolve & form new temporary or permanent MC for 5 years ?
As per new amendment what is solution ?

Better option is to approach the Registrar.

1. File proper petition before the local ward Coop. Registrar, on non-conducting AGM issue and have the Mg.Committee members disqualified from the Mg.Committee, for five years, alongwith penalty of 5000/- on them.

Yes Dhingra sir...but other members suggested to get experts advise before going ahead... we were looking for changing MC within society immediately.

You may change the MC, as per the provisions of the byelaws of the society duly approved by the Registrar of the Society, but not beyond the scope of the byelaws, even if the experts advise you otherwise. Nobody can scrap the MC except through impeachment through the prescribed majority in the AGM or by the orders of the Registrar of the society, if workig against the cooperative law.
