Can a passport for 5yrs be issued to a person against whom a criminal case is pending in court

As per procedure in place , Issue of Passport is preceded by Police verification until recently.So, there may be a mistake like this. However, in case you have substantive evidence of such lapse, you can very well bring the same to the knowledge of jurisdictional Passport authority .
