Rectification of wife's name in service book and joint notification for pension

(Querist) 17 January 2016 This query is : Resolved
Sir,

I am an ex-serviceman drawing pension from defence. I married SINDU KR in 2003 and marriage was registered. Thereafter I got her named registered in service record as SINDU R PILLAI (Full form as SINDU RAGHUNATHAN PILLAI). Which is my name added to her name and this was her post marriage name.

I got discharge from service in 2009 and am getting my pension thereafter.

In 2009 my wife deserted me and there is no contact between us. In 2015 I filed a petition in family court in which her name was mentioned as SINTHU KR (her present official name). She did not contest the case. So it was set exparte and divorce was granted. In the divorce decree her name is entered as SINDHU KR.

Now I have to get her name removed from service record and the joint notification for family pension.

Her name which appears in service record is SINDU R PILLAI and the name in the divorce decree is SINDHU KR. Due to this difference in name I am unable to proceed further.

Is there any procedure of getting it rectified?

Thanks.

You should have used both the names so no confusion had been there.
You can swear an affidaivt from 1st class Magistrate as well.
Anyway if from the divorce suit and decree there is no ambiguity as regards the identity of your wife then the department is bound to do so. Else file writ petition in high court.

Simply intimate your pension sanctioning authority about the divorce and enclosing the divorce decree, and request the department to remove her name as your wife. Either send your intimation through REGISTERED POST or by hand and obtain acknowledgement.
After 3 or 4 months of sending such an intimation, obtain information through RTI by asking the following query:
1. Whether intimation dated .... (copy enclosed) sent by Registered post dated .... was received?
2. Whether necessary action to remove the name of ............. as wife of the pensioner has been taken?

AFTER THE ABOVE TWO actions YOUR JOB IS OVER. Rest is department's problem and not yours.

Well advised, agree with the expert Anirudh.
