If i am going to a restaurant... I consume food and I am not able to pay up my bill... In return if the manager confines me or restrain me from going outside the restaurant can I sue them for wrongful restraint or wrongful confinement of IPC???
Anirudh (Expert) 18 January 2016
If you come to my house, burgle something and while attempting to go outside, if I catch you, tie your hands, make you sit and put some more of my friends around you to prevent you from moving/fleeing, it is perfectly ok and no wrongful confinement.

The situation presented by you is a perfect example of the proverb "Ulta chor kotwal ko dante".

In IPC no one is given Power to man handle or Punish or Retain any one even if the Person is an Offender. They could only hand over him to Police. In extra ordinary Circumstances the affected persons could use force only to protect them selves. No one could take Law in their hands.Consult a Local good advocate.
