Tenant not vacating rented house

(Querist) 01 January 2017 This query is : Resolved 
My tenant after expiry of 11 months agreement is not vacating. He has not paid rent and adjusted it against advance paid to me. He continues to pay rent each month promising that he would vacate shortly. I issued him an eviction notice and acknowledged the same sent by speed post. But he continues to extend his occupation and no signs of his vacating.

Pl let me know under which section of law prevalent in Karnataka can be used to legally evict him.

Sorry to say you being the Land Lord you will be favoring the Tenant by going to Court.He also would approach an Advocate who would advise him to pay the Rent in Court and it would be an Never ending story.Better Try to Sort it amicably and try to vacate the Tenant with the help of local good people.

You can get the premises vacated either by mutual consent or through court orders.

For court orders, move to court.

Don't accept the rent. As 11 months of Leave and License has expired send him legal notice to vacate the premises, and if he fails to do so within the given period as per the said legal notice, File eviction case against the Licensee.

I have to agree with Mr Narasimha.

If you file civil suit you will give his present address and his occupation is proved and then you prove your ownership in the court which he has s right to dispute.
