Grandfather's property

Querist : Anonymous (Querist) 29 May 2010 This query is : Resolved
My grandfather got a agricultural land in Haryana through gift from Britisher's in between 1940-1950, I don't know exactly. After my grandfather's death it was divided among his three son's.My father was one of them, he passed away last year leaving a registered will in my favour. On the basis of that will I transfored that property in my name.We belong to Hindu family.

1. Is my father's will valid.
2. Can my sister's demand their share in that property.

1your father's will is valid to the extent of your father's own share.
2. your sister can demand her share in the property as per amended law of succession 2005.

Since your father expired last year, the WILL becomes effective after his death. As the said WILL pertains to the ancestral property it is not valid, hence, your sister can very well demand her share. It is suggested that instead of wasting time& money and losing sister's love and affection, go for an amicable solution by providing her the requisite share/it's value and get the execution properly registered so as to avoid future conflicts.
