Non Life General Insurance Claim for Permanent Disability

I met with an accident and got permanent disability of 45%.Vehichle in which i was going covers under general insurance policy from National insurance company. In the Policy cover note, it is clarly written thatpolicy covers “unnamed passengers number 9, amount 100000 per person” But company refused for any claim and said claim is applicable for 100 % permanent disability not for 45% permanent disability. I want to know whether i am eligible for the claim from National Insurance company or not.

what does the policy document says regarding percentage of disability for admitting the claim.

if no specified percentage is mentioned,you can claim.

if a specified percentage is mentioned and your disability is below that,you wont get anything.

Well percenrtage is a general term there is no strict scale for it , so file claim invite few experts as witnesss and you may get claim.
