property deal-court attachment order

Querist : Anonymous (Querist) 20 January 2011 This query is : Resolved
after completing the reagistration and obtaing document of a land property whether a court can issue an attachment order against a case filed against seller. what is the cut off date for filing the case
Parveen Kr. Aggarwal (Expert) 20 January 2011
If the property has already been sold/transferred by the Judgment debtor then the property cannot be attached as the property is no more of the judgment debtor but if the court finds that it is a fraudulent transfer, the court can ignore it.
adv. rajeev ( rajoo ) (Expert) 20 January 2011
If it was attached before judgement then judgement debtor(seller) will be liable. If there was no attachment and if the court attaches the already sold property it is not biding on the purchaser.
Devajyoti Barman (Expert) 20 January 2011
The cut off date s the date of order for attachment , not the date of registration.
Advocate. Arunagiri (Expert) 20 January 2011
I agree with Mr.Rajoo.
