498a, 406, and DV act

Hi friends,
1. Divorce case filed by me.

2. After that my sweet wife filed DV Act & 498a is pending under investigation in CAW Cell delhi.

3. I got stay order for one week & and for other family members courts directs to the IO, to have the permission from ACP/DCP before arrest them.

4. My wife is working before and after marriage.

5. In DV act court sent for mediation, next date for same end of the july.

6. In CAW Cell mediation i refused to live with my wife and she want live me.

7. I sent a RTI application to CAW Cell for asking 07/2007 circular and cirtified stridhan list. no reply recieved..15 days past.

My Questions-----

1. How can i stop to register the case ?
2. what are the counter cases to be filed against my sweet 498a.

1. you could not stop filing a case unless otherwise amicable settlement.
2. they made out primary allegations with proof then only will punished otherwise its dismissed,

you can file quash petition,

COUNTER CASE AGAINST ANY CRIMINAL CASE?
NO NO YOU CAN'T DO THAT,
HOWEVER IF THERE IS ANY CRIME AGAINST YOU OR YOUR PROPERTY BY HER THEN YOU CAN FILE CASE REGARDING THAT MATTAR!
YOU CAN DEFEND 498A ONLY AND
WHEN YOU WIN THEN YOU CAN FILE CASE!

your wife is exercing her right for that you have to collect evidence and proofs so that you can defeat her.

If there is ground then definitely you can file counter case but for that the case history needs to be known.

If no reason is there then we can not advise you to file false cases.
