Declaratory suit

Querist : Anonymous (Querist) 01 December 2011 This query is : Resolved

A certain document on plain stationery is signed by a few people. One of them denies signing the document and alleges his signature to be forged. Is there any limitation period within which he (the one whose signature is alleged to be forged) should take the issue to court to have the document declared null and void.. If yes, what is the limitation period and under which article of the schedule.
Would our experts guide?

3 years from the date of execution of that document or when it came to the knowledge of the person

Why not refer the Handwriting Expert, get his Opinion, then go for declaration of the doc as null & void.
U must prove, u came to know within last 3 years, and u had no access to the forged doc, or no one inform u about it earlier.
Advocate Bhartesh goyal (Expert) 01 December 2011
YES YOU CAN FILE SUIT WITHIN THREE YEARS FROM THE DATE OF KNOWLEDGE OF SUCH FORGED DOCUMENT.

Add:-you can also take criminal action, there is no time bar.

Devajyoti Barman (Expert) 01 December 2011
First file a suit and then go for appointment of handwriting expert who would be appointed by the court only.
Prior report may not be binding on the court.
