As everybody know Anna stated in his speech that 'yeh sarkar hai yaa- Baniye ki dukaan"
I am a baniya by caste, i want to file a case of defamation against Anna Ji,kindly help and suggest me.Regards

The general words casting aspersion about a certain class can indeed be a defamatory if a person belonging to such class can show that such words did bring disrepute to him.
In one case when an ex Indian Cricket captain told-' sab bihari chor hai', defamation case did get started against him.

Aap ko to Anna ne "SARKAR" ka owner BANA DIYA!! kya ye "Defamation hai ki fame hai??
Ap ka Dukan to aur jor se chalega.
""Baniya nahi; baniye ki dukkan"chalegi.
You are above Sarkar, The Government .
Baniya will first check Profit & Loss , before Purchasing anything??
If he gain more after selling, and can Profit out of it, he will purchase goods for Sale. Is it true??
Then he has to keep account of his Purchase, Time and investment cost, Process and management cost, risk factor, etc., and ultimately Profit.

You have to follow same calculation in this case also, and prove that you lost, or damage this much money or reputation, as me x,y,z stopped dealing with you due to the statement of Shri Anna,
You have to prove that he defamed you, or your Dukkan , and you incur loss due to that statement .
Analyse in beginning, before purchasing this Legal Procedure of defamation, will yield Profit or Loss, and either take it or leave it,.
Choice, investment and risk is yours, It will certainly Profit us, the Lawyers.

There is no defamation for baniya by uttering these words by Anna Saheb because he only denoted the job of baniya. Had he use the words that 'Ye baniye hain ya UPA sarkar' only then it might have been defamatory for a community keeping in view 'highest repute' this government is bearing.

hear comparing to "SARAKAR" is the defamatory thing... :)

In your words, "bania" and "baniye ki dukan" are the same thing? In other words, do you compare "baniya" and "dukan" on equal footing.
Do you run a dukan, which sells grocery or negotiate for prices?
No harm in filing a case against Anna, if you are merely litigation-friendly and want to taste a defeat in the court, when Shanti Bhushan and Prashant Bhushan like lawyers of high repute are already with him.
