Sir My brother hit a 2 wheeler form back side in express high way.the person who was riding a bike suddenly applied the break.my vehicle was in 80 speed.i went and hitted from back side.the person who was sitting back side of bike came and fell on my car glass.my car is full damaged.the person who was riding the bike dont have driving lisence.but now they gave complaint that the person who was siting
back side of bike he himself was riding the vehicle.as accident happend in his village no one redy to give avidence as he was siting back side.what can i do.

will it become criminal case please let me know sir.Help me

you should also have filed a cross FIR against the person driving bike without the licence.Does pillion rider claiming driving has the licence.?
