hi,
well i have bailable warrant for accused and i m trying to get served on accused but the accused family members not let police go in nor tell where he and tells that he is outside from state ,i.e they r playing with me ,so pls suggest me that can i do the chasbha of bailable warrant or how to get served on him or how to get arrest warrant if these bailable warrants are not served on accussed,pls reply urgentily as my date in court is 21 march 2012

Report the matter to the Magistrate that the accused is absconding and a NBW will be issued subsequently.

please file an application stating the fact before the trial court supported by an affidavit on the next date praying to issue a N B W A If police failed to execute the warrent. IN my opinion court will allow your application.

is there any ruling by any higher court of india regarding proclamation on the refusal of service of bailable wrrant under 138 ni act
and is there any ruling by any higher court of india regarding accused absconding and on that migstrate can issue non bailable warrant

It is a process under CrPC, why you need a ruling.
