Dear Expert,
My wife is Judge in court. She is earning Rs 50000/- per month. I am earning 43000/- per month.
She wants divorce.Her parents forced her for divorce.
As she is govt class one employee, will law give soft corner to her?
Will she create any problem to me ?
According to my opinion if she is earning more than me, I need not pay any thing.
Further I have a houseproperty constructed by my father but is in the name of me.
Will she entitled to claim any share in that property?
Suggest me some safe ways that will not harm me?
Plz guide I am in big trouble.

if your wife is a judge she knows the law . if she wants divorce do it by mutual consent . if she is earning 50,000 a month no question of maintenance .
she has right to stay in shared household under DV act . dont panic . settle all issues amicably

Dear Querist,
Wife is not entitled to any maintenance - on the contrary you can try to seek maintenance if the case turns contested.
Mutual Consent is the best thing to go in for, however if she does not agree - then it becomes contested - watch out for 498A/406 that they may try to implicate you into.
As regards property no right - she must have an accomodation to her as judge.

Go for divorce by mutual consent.
Otherwise, if your initiates the action by filing the petrition, then you can give your consent to the same instead of contesting. Try to settle the same amicably.
As advised above, your wife will not be eligible for any maintenance as she is earning much more than you.

You have not stated the reasons for your in laws advising your wife to seek divorce. Your wife being a judge, may not be simply guided by your in laws unless she feels that your conduct is not conducive to continue the relationship. As advised by experts MCD is advisable.
