i worked for a company from jan 2006 to aug 2012
while settling my account company didnot pay me gratuity.
now this is april 2012.
am i eligible to claim gratuity, and can i get it and how to apply for it
the company is in Rajkot Gujarat,

you send the legal notice to the employer . if they not turned then take action by the local lawyer.

SINCE YOU WORKED THERE FOR A PERIOD OF MORE THEN 5 YEARS, SO YOU ARE ENTITLED TO GET GRATUITY.SO FIRST OF ALL GIVE A LEGAL NOTICE TO THE COMPANY AND STILL YOU DO NOT GET YOUR GRATUITY,THEN FILE A CIVIL SUIT.

Pl. file an Application in the court of Controlling Authority ,Payment of Gratuity Act, 1972 (labour Court) either by self or through an Advocate or any Authorised Representative, as per prescribed proforma.
For details, pl. consult any book on Payment of Gratuity Act.

Jan 2006 to Aug 2012 means 6+ years of a service.yes ! you are entitled to Gratuity.Act as guided by Mr. A.K.CHANDOK.

Mr. Chandok rightly replied, but dont send legal notice to your previous employer. send simple letter stating the facts, in the alternate send the same letter to HR Head and CC to MD. if you dont get reply or gratuity fund, approach to Controlling authority. Please appreciate there are two set of controlling authority i.e. state & central. select accordingly.

If you are sure that your name was in the pay roll of regular employees of the company for more than 5 years and if there is no enquiries pending against you, you must be eligible for gratuity. Cause to send a legal notice through an advocate practicing labour matters, on behalf of the employees.
