Resignation from the job

Dear Sir,

Iam working as postal assistant(clerk) in post office. I applied for resignation as Iam going to pursue higher studies. But my resignation was rejected by the officials, saying that the staff was shortage. But I have to leave my job urgently as i have to go for coaching for further studies. So what should I do in this situation. Can I proceed legally to be releived from my job

dont resign . apply for study leave

since your resignation was rejected due to staff shortage,you may not get leave either with or without pay.still you may try that option.

you can resign as per the terms of your employment either by giving required no. of days notice period or money in lieu of notice period.

Study leave is not admissible in this case. This is givne if he has served for 5 years, willing to serve for 5 years after expiry of leave and if in the opinion o fht deptt the course to be folowed is useful to the present assignment.

The reason put forth by the authorities is frivolous does not stand to any legal reasoning. Unless there are compelling circumstances like pendency of inquiry or recovery proceedings and the like, no force on the earth can ever refrain you from resigning. If there is condition in the appointment order that any previous notice is necessary, you have to give notice. You are free to quit at your pleasure.
