Dear Experts,
Can Diverce petition filed by a wife pending disposal before the court.in the mean time both parties wants to settle the matter before LOK ADALAT.Can diverce petitions pending before the court can come under perview of the LOK ADALAT? kindly advice in the best interest of the both parties.

Divorce Petitions are not taken up by Lok Adalats as far as i Know, Lok adalats are known to put a quietus on the issue by speedifying the process, which is not suitable for matrimonial cases which need a slow compassioante approach. Rather Concilliation/Mediation is more suited to such cases.

yes refernce can be made to lok adalat if both parties desire . Lok Adalat is to help the parties to come to terms, record their statements as regards their decision to dissolve the marriage by mutual consent and do all other necessary act in this direction -. it cannot pass a decree for divorce by mutual cossent

yes the case case be referred to Lok Adalat and it can be settled there.

the issue can be referred to the lok adalat but the decree by mutual consent can only be granted by the family court.

Lok Adalat can only bring about an agreement between you. Divorce would need to be granted by competent court.
