Protection of women from domestic violence act, 05

(Querist) 12 September 2012 This query is : Resolved 
Sir,

I have a sister married to an army personnel. My sister is being harrassed by both physically and mentally and it seems that the marriage is not working properly. We have now decided to lodge a complaint under "Protection of Women from Domestic Violence Act, 05". Could learned counsel please help me in following.

(I) Where or to whom i may file this complaint?

(II) Can I file this compliant on behalf of my sister?

(III) Can it be filed to the proper authority away from the place of my sister's matrimonial residence?

(IV) What recourse is availabe under section 156 (3) of CrPC.

(IV) Who are majistrate under the said section (156 (3) of CrPC)?

before magistrate court wherein your wife is residing .

it is advisable your sister files complaint as she is personally aware of facts of the case .

156(3) is complaint made to magistrate to direct cops to investigate the offence
