Jurisdiction of a foreign company in india

(Querist) 23 November 2012 This query is : Resolved
Can a 100% foreign company file a suit against an Indian under employment related matters of dispute. A friend of mine was recruited by foreign company and within a month the employment contract was terminated due to some legal issues from the previous employer of the person. Now the previous employer wants to sue the foreign company, and the person is asked to give statement accusing the foreign company of using the person to obtain information and later on dumping him. The person is now under fear. Can a foreign company file suit in India. Kindly help advise and reply to: helptosaveme@gmail.com

if the previous employer wants to sue the company why are you worried ? you dont mak any statement against the foreign company . let them fight out their legal battles . companies can afford to engage best legal brains to fight their case .

As cause of action has accrued to the plaintiff in India, the foreign company running its operation in India can very well be sued as per provisions of CPC,
