Land and trees

Dear Sir,
My uncle planted 4 trees on a land before partition . 3 years ago the partition took place and the trees belong to our area now. Now when we are planning to build house on the land my uncle is saying that he will cut all the trees because he has planted and nurtured them. The trees will cost nearly 1 lac rupees.
My question is whether I have legal rights to object his action please?

In general in the partition deed itself it should be mention like land with trees. If it is not mentioning also you have a legal right to object his action. Because among 4 trees, you have also right is there.

Trees cannot be of his own. But need to look in to the contents of the Partition deed

There is nothing mentioned in the partition deed regarding trees.
